As we can accept your order and make a legally enforceable agreement without further reference to you, you must read these terms and conditions to make sure that they contain all that you need and nothing that you are not satisfied with. If you are not sure about anything, please phone us on 01905 420170 for clarification.
Application

These Terms and Conditions will apply to the purchase of the services and goods by you (the Customer or you).

Pumpmaster trading as Pumpmaster UK Ltd of Manor House Offices, Malvern Road, Worcester, WR2 4BS (the Supplier or us or we).

These are the terms on which we sell all Services and Goods to you. By ordering any of the Services or Goods, you agree to be bound by these Terms and Conditions.
Interpretation
-
Consumer means an individual acting for purposes which are wholly or mainly outside his or her trade, business, craft or profession.

Contract means the legally-binding agreement between you and us for the supply of the Services or Goods.

Delivery Location means the Supplier’s premises or other location where the Services are to be supplied, as set out in the Order.

Goods means any goods that we supply to you, of the number and description as set out in the Order.

Order means the Customer’s order for the Services or Goods from the Supplier.

Services means the services, including any Goods, of the number and description set out in the Order.
Services
-
The description of the Services and any Goods is as set out in our website or other forms of advertisement. Any description is for illustrative purposes only and there may be small discrepancies in size or colour of any Goods supplied. Technical specifications are as per manufacturers’ website and brochures.

In the case of Services and any Goods made to your special requirements, it is your responsibility to ensure that any information or specification you provide is accurate.

All Services are subject to availability.

We can make changes to the Services which are necessary to comply with any applicable law or safety requirement. We will notify you of these changes.
Customer Responsibilities

You must co-operate with us in all matters relating to the Services, provide us and our authorised employees and representatives with access to any premises under your control as required, provide us with all information required to perform the Services and obtain any necessary licences and consents (unless otherwise agreed).

Be aware:
a. If the work carried out is not covered under the terms of the warranty provided by the manufacturer of the pump, liability for settlement of the invoice rests with you.
b. All prices are subject to VAT at the applicable rate.
c. Payment will be made on completion or terms as agreed beforehand.
d. If parts are replaced, they are charged accordingly.
e. Reports additional to those issued by the engineer at site will be charged at £37.50 + VAT.
f. Failure to cancel a visit within a reasonable time may incur a cost equal to 50% of the planned visit.
g. All products should be installed in accordance with manufacturer guidelines. Failure to adhere may result in work not being carried out and an invoice being raised equal to that of the planned visit.
h. It is the responsibility of the customer to inform Pumpmaster UK Ltd of any restrictions regarding parking and access. Parking charges and fines will be added where applicable.
i. Concealed products must be exposed prior to the engineer’s visit. Access is required to lid, discharge and inlet connections. Failure to provide access will result in an invoice being raised even if works are not carried out.
j. Tenanted properties will not be entered without the presence of the tenant or a managing agent representative.
k. Services may be withheld for properties managed by an Agent where invoices remain unpaid.
l. No supplier commission or agent discount applies.
m. It is not Pumpmaster’s responsibility to chase tenants for access. An invoice will be raised if the site representative fails to be present.
n. Congestion, Zero Emissions or Low Emission charges will be added where applicable.
o. All Commercial Premises must have had a Refurbishment/Demolition Survey carried out to establish whether asbestos is present.
p. Associated faults with old or poorly maintained pipework and plumbing are not the responsibility of the attending engineer.
q. Where invoices are not settled within stated terms, the matter may be passed to a collection agency. We reserve the right to charge statutory interest and debt recovery compensation under the Late Payment of Commercial Debts (Interest) Act 1998.

Failure to comply entitles us to suspend performance or terminate the Contract.
Basis of Sale

Website descriptions do not constitute a contractual offer.

We may reject an Order for any reason.

Quotations are valid for 28 days unless withdrawn earlier.

Variations must be agreed in writing.

These Terms apply to Consumer Contracts entered at our business premises unless otherwise agreed.
Fees and Payment

Fees are as set out in our price list at the date of Order or otherwise agreed in writing.

Fees include VAT at the applicable rate.

Payment for Services must be made on completion unless otherwise agreed. For online purchases, payment is taken at checkout.
Delivery
-
We will deliver Services and Goods within the agreed period or within a reasonable time.

If you were entitled to treat the Contract at an end but do not do so, you are not prevented from cancelling the Order for Goods delivered and we will return payments made.

If Goods form a commercial unit, you cannot cancel part only.

We may deliver in instalments for genuine reasons without extra charge.

If you fail to take delivery, we may charge reasonable storage and redelivery costs.

Goods become your responsibility upon delivery or collection.
Risk and Title
-
Risk passes upon delivery.
-
Title remains with us until payment in full is received.
Withdrawal and Cancellation

You may withdraw an Order before Contract formation.

For Goods purchased online or at a distance, Consumers have the right to cancel within 14 calendar days of delivery. Goods must be returned unused and in original condition at your expense. Refunds will be processed within 14 days of receipt of returned Goods. This does not affect statutory rights relating to faulty Goods.
Conformity

We have a legal duty to supply Goods in conformity with the Contract.

Upon delivery, Goods will be of satisfactory quality, fit for purpose and match their description.

Failure caused by your materials is not our responsibility.

Services will be supplied with reasonable skill and care.

Statements relied upon form part of the Contract subject to qualification and agreement.
Duration, Termination and Suspension

The Contract continues until Services are completed.
-
Either party may terminate for serious breach not remedied within 30 days.

Termination does not affect accrued rights.
Privacy
-
We process personal data in accordance with applicable UK data protection law.

By entering into a Contract with us, you acknowledge that you have had the opportunity to review our Privacy Policy.
Successors and Sub-contractors

Either party may transfer the benefit of this Contract. The Supplier remains liable for acts of chosen sub-contractors.
Circumstances Beyond Control

Neither party is liable for failure caused by events beyond reasonable control.
Excluding Liability
-
We do not exclude liability for fraud or death or personal injury caused by negligence. We are not liable for losses not reasonably foreseeable at the time the Contract was formed.
Governing Law and Complaints
-
Governed by the law of England and Wales.

Disputes may be submitted to courts of England and Wales (or Scotland/Northern Ireland where applicable).

Complaints should be made in writing. We aim to respond within 5 working days.
